Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Betta Work (“we”, “us”). They apply when you use the Betta Work website, bettawork.ng, or the Betta Work app (together, “Betta Work”). By creating an account or using Betta Work, you agree to them. If you do not agree, please do not use Betta Work.

Our Privacy Policy explains how we handle personal data, and our Community Guidelines form part of these Terms.

What Betta Work is

Betta Work is an online marketplace. It helps people who need a service (“customers”) find and contact independent service providers (“professionals”), such as mechanics, plumbers and electricians, near them.

Betta Work is not a party to any job. We do not provide the services listed, employ professionals, supervise their work or set their prices. Any agreement for work, including what will be done, when, the price and the payment, is made directly between the customer and the professional.

Professionals are independent businesses. They are not our employees, agents or partners, and nothing on Betta Work creates that kind of relationship.

Your account

  • You must be at least 18 years old and able to enter a binding contract under Nigerian law.
  • Give accurate information, including a phone number you can be reached on, and keep it up to date.
  • One person, one account. Do not create an account for someone else without their permission, or open a new account after we have closed yours.
  • Keep your password private. You are responsible for what happens on your account. If you think someone else has used it, tell us at once at hello@bettawork.ng.
  • A business profile must be for a business you own or are authorised to represent.

Prices and payment

Betta Work does not take, hold or process payment for jobs. Customers pay professionals directly, in whatever way they agree.

Prices on a profile are the professional’s own guide prices, usually “from” prices, and are not binding offers. Before work starts, agree the final price, what it includes and when it is due with the professional.

Refunds, warranties and disputes about payment are between the customer and the professional. We may look into a report, but we are not responsible for payments or refunds.

Using Betta Work is currently free. If we introduce paid features, we will show the price and terms before you pay for anything.

If you are a professional

  • Describe your business, services, prices, location and availability honestly, and keep them up to date. List only trades you are qualified to do and, where the law requires, licensed to do.
  • You are responsible for your work, for obeying the laws that apply to your trade (including licences, permits, taxes and safety rules), and for any insurance you need.
  • Answer requests promptly, or decline them. A request left unanswered for 48 hours closes automatically.
  • Use a customer’s details only to deal with their request. Do not add them to marketing lists or pass them on.
  • Upload only photos of your own work, or photos you have the right to use.

If you are a customer

  • Describe the job honestly, and be available at the place and time you agreed.
  • Pay the professional what you agreed for the work done.
  • Use a professional’s phone numbers only to arrange a service.

No guarantee of work

We show information to help you choose, such as ratings from completed jobs, jobs done and response times. But we do not vet, license or guarantee professionals, and we do not guarantee the quality, safety, legality or timing of any work, or that a professional or customer will do what they said. Any badge we show, such as “Verified”, covers only the specific check it describes and is not a guarantee of work.

Before you hire, read the profile and reviews, agree the price and the work, and follow the safety tips in our Community Guidelines.

Acceptable use

You must not:

  • break the law, or offer, request or arrange anything illegal;
  • post false, misleading or fraudulent content, including fake profiles, fake reviews, or prices you do not intend to honour;
  • harass, threaten, abuse or discriminate against anyone;
  • pretend to be someone else, or misrepresent your connection with a business;
  • copy or collect other users’ data, including phone numbers, by automated means or otherwise, or use it for anything other than arranging a service;
  • send spam or unsolicited advertising through Betta Work;
  • interfere with Betta Work’s security or operation, including probing, overloading, reverse engineering, or getting round rate limits or access controls.

The Community Guidelines explain these rules in everyday terms.

Reviews

  • Only the customer on a request that was marked completed can review it, and only once. There is no other way to leave a review. That is what makes the ratings worth trusting.
  • Reviews must be honest, based on your own experience of the job, and free of abuse, threats and personal information. Do not offer or accept money or favours for a review, or pressure anyone to change or remove one.
  • Professionals may reply publicly to reviews. Replies follow the same rules.
  • We do not edit reviews. We may hide a review that breaks these Terms or the Community Guidelines. We do not remove a review just because it is negative.

Reports and removal

Anyone can report a professional from their profile, and our team reviews every report.

If three different signed-in people report the same professional within 30 days, the profile is hidden from search automatically while we review it. The professional is told, and each signed-in reporter is told when the review is finished.

We may remove content, hide a profile, or suspend or close an account that breaks these Terms or the Community Guidelines, or that we reasonably believe puts others at risk. Where we can, we will tell you why. If you think we got it wrong, email hello@bettawork.ng and a person will look at it again.

Your content

You keep ownership of what you post: your profile text, photos, services, reviews and messages (“your content”).

So that we can run Betta Work, you give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, resize, format and display your content on Betta Work and in search engines, and to show public profiles, photos and reviews when promoting Betta Work. The licence ends when you delete the content or your account, except for reviews and request history, which stay in anonymised form as our Privacy Policy explains.

You confirm that you have the right to post your content, and that it does not infringe anyone’s rights or break the law.

Our intellectual property

The Betta Work name, logo, design, software, and the content we create belong to us or our licensors. You may use Betta Work for its intended purpose, but you may not copy or reuse our brand, design or software, or build a competing database from Betta Work’s listings, without our written permission.

Disclaimers

Betta Work is provided “as is” and “as available”. We work to keep it accurate, available and secure, but we do not promise that it will be uninterrupted or error-free, or that information posted by users, including profiles, prices, availability, locations and reviews, is accurate or complete.

Nothing in these Terms takes away any right you have as a consumer under the Federal Competition and Consumer Protection Act 2018 or any other Nigerian law that cannot be excluded by agreement.

Limitation of liability

Because Betta Work is not a party to any job, we are not liable for what a customer or professional does or fails to do, or for loss or damage arising from a job, a payment, or a meeting arranged through Betta Work.

As far as the law allows, we are not liable for indirect or consequential loss, or for loss of profit, business, revenue or data, arising from your use of Betta Work.

As far as the law allows, our total liability to you for all claims relating to Betta Work is limited to the amount, if any, you paid us in the 12 months before the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under Nigerian law.

Indemnity

As far as the law allows, you agree to indemnify Betta Work and its owners, officers, employees and agents (together, the “Betta Work parties”), and to hold them harmless, against any claim, demand, loss, liability, damage, fine, cost or expense (including reasonable legal fees) made by anyone else or arising from:

  • your breach of these Terms, our Community Guidelines or any law;
  • anything you post on Betta Work, including your profile, photos, prices, messages and reviews, and any claim that it is false, misleading, defamatory or infringes someone’s rights;
  • a job you request, offer, carry out or pay for, and anything you do or fail to do in dealing with another user, including injury, damage to property, and money paid or owed between you;
  • if you are a professional, your trade, qualifications, licences, permits, insurance and taxes, and the work of anyone you bring to a job;
  • any misuse of your account, including by someone you let use it.

If a claim is made that this indemnity covers, we will tell you about it promptly where the law allows, and you will co-operate with us in dealing with it. We may choose to handle the defence ourselves; if we do, you will still cover the costs described above. You may not settle a claim that affects us without our written consent.

This indemnity does not apply to the extent a loss was caused by our own negligence, fraud or breach of these Terms, and it does not take away any right you have as a consumer that cannot be excluded under Nigerian law.

Ending your account

You can stop using Betta Work and delete your account at any time. See Request Account Deletion.

We may suspend or close your account, with notice where practical, if you break these Terms, if the law requires it, or if your account puts others at risk. If we stop offering Betta Work, we will give reasonable notice.

The parts of these Terms that by their nature should continue after your account ends, including the licence for anonymised history, the disclaimers, the limitation of liability, the indemnity and governing law, continue.

Changes to these Terms

We may update these Terms as Betta Work changes. We will update the date at the top and, for significant changes, tell you in the app or by email before they take effect. If you keep using Betta Work after that, the new Terms apply. If you do not agree, you can delete your account.

Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria.

If you have a complaint about Betta Work, email hello@bettawork.ng first; most problems can be settled quickly that way. If we cannot resolve it within 30 days, either of us may take it to a Nigerian court with jurisdiction. This does not affect your right to complain to the Federal Competition and Consumer Protection Commission (FCCPC).

A dispute between a customer and a professional about a job is between them. Where the law allows, we may help with information from reports and the request history.

General

If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these Terms; we may transfer ours to a successor that takes over Betta Work. These Terms, with the Privacy Policy and Community Guidelines, are the whole agreement between you and us about Betta Work.
